How To Track Project, Promoter, Agent And File Complaint On Rajasthan RERA Portal

Rajasthan implemented Real Estate (Regulation and Development) Act (RERA Act) 2016 in the early 2017. The Act mandates all the real estate projects in the State to be registered under the RERA Authority, except the following:

• If the project is below 500 sq mtrs.
• If the total number of apartments in the project is less than eight.
• If the project had received completion certificate before the implementation of the Act

The Rajasthan RERA has imposed heavy penalty for developers who fail to register their projects. A builder needs to pay ten times the normal registration fee or two per cent of the total project value as penalty, whichever is higher.

How to track a project? 

While it is mandatory for all the real estate developers to register their projects with the RERA Authority, there might be a few who may not have done it. This is of foremost importance that you check the registration status of the real estate project you intend to buy property in.

Also, if you are undertaking the transaction through an agent, then you must also check whether the agent has been registered with the Authority or not.

Here is how to do it.

Firstly, visit http://rera.rajasthan.gov.in/

Click on the ‘Search’ menu and you will come across two options: ‘Project Search’ and ‘Agent Search’.

From here, you can click on ‘Project Search’ and verify whether the project has been registered with the Authority or not. There is no mandatory field and you can search the terms you know and check the results. Even the first few words of the project name or developer will get you close results. 

Similarly, you can click on the ‘Agent Search’ option and check whether the agent or his company is registered or not. You must deal with the registered agents only and steer clear of the ones who are not found on the portal.

How to file a complaint against a developer or an agent?

In order to file a complaint offline, you can fill-up the complaint form in the prescribed format. You can either file the complaint with the RERA Authority or the designated Adjudicating Officer empowered to resolve the issues.

In order to file the complaint through the online form, you will need to fill up information about yourself including your contact details. More importantly, you will have to make sure that the issue you are raising with the Authority or the Adjudicating Officer falls under their jurisdiction.

What is the difference between ‘Complaint to RERA’ and ‘Complaint before Adjudicating Officer’?

The complaint to RERA could be filed if the issue is about violation of the RERA Act. On the other hand, if the complaint is about interest and compensation, then it must be filed with the Adjudicating Officer.

Also, it is advisable to draft the complaint offline and then copy-paste it in the online form. This way, you can cross-check all the facts and figures being shared in the complaint. The more comprehensive you go with your matter and strengthen it with the supporting documents and evidences, the better the chances will be for a quick resolution.

An application fee of Rs 1,000 will be payable in order to submit the application. In the end, it should help the Appellate Tribunal to take a decision on the matter. So, take the necessary time needed in order to develop a proper draft and check it thoroughly before uploading it.
