UP RERA To Follow MahaRERA Model Of Complaint Resolution

When the four officials of the Uttar Pradesh Real Estate Regulatory Authority’s (UP RERA) Greater Noida Bench started working formally from September 4 — they have been extensively meeting builders, buyers and other stakeholders to have a clear understating about what they have to deal with — they followed the example set by their Maharashtra counterparts.

The MahaRERA is leading by example.

Reports say the MahaRERA has in the past one year resolved as many as 2,220 cases. The feat was achieved by hearing 25 cases every day and by concluding hearing in a matter of one month. More importantly, the authority was able to amicably settle 80 per cent of these cases out of court, saving all parties time, resources and energy.

The Greater Noida Bench of the UP RERA, on the other hand, has to resolve as many as 4,000 complaints from Noida, Greater Noida, Ghaziabad and Meerut. The Lucknow Bench has to hear about 2,000 complaints.

On the first day of its operations, the Greater Noida Bench of UP RERA heard 31 complaints. All these complaints were against a Noida-based developer that has failed to deliver apartments in three projects in past 10 years. The three projects are Earth Sapphire, Earth Towne and Earth Tech One. 

While two members of the authority would hear complaints at the Gamma 2 area of Greater Noida on four days, the remaining two would hear complaints in capital city of Lucknow. The Noida Bench would function on Monday, Tuesday, Thursday and Friday while the Lucknow Bench of the RERA would hear buyer complaints on Wednesday. Mobile courts would also be set up to ensure pending cases are resolved quickly.

The key focus of the authority would, however, be to help homebuyers get delivery of their flats. Several real estate projects in the national capital region are stuck owing to a variety of issues, and lakhs of buyers have been waiting for their homes for a long time, some for over a decade. Since 80 per cent of the total complaints received by the UP RERA are from the National Capital Region (NCR)-belt, it was decided that a separate Bench is set to resolve cases here at a faster speed.

Members of the panel, which is headed by Chairman Rajeev Kumar, have been negotiating with Noida, Greater Noida and Yamuna Expressway authorities and representatives from developers body Credai (Confederation of Real Estate Developers’ Associations of India) to understand the ground reality.
