Execute Flat Registration By Oct 15 Or Face Action, Authority Warns Ghaziabad Developers
A total of 46 developers in the city who have failed to execute flat registration so far have received notices from the Ghaziabad Development Authority (GDA). The authority has told these builders to complete the task by October 15 or face action. These developers have received full payment for the flats, and have given possession to homebuyers.
According to the GDA, in case these developers fail to register flats before the set deadline, a legal action will be taken against them under the provisions of the UP Apartment Act and the Registration Act. Under the provisions of the UP Apartment Act, a developer has to first get the sale deed executed and give possession of a unit after that.
These developers were also issued notices earlier for failing to get registries of flats in favour of homebuyers.
According to the Section 13 of the UP Apartment Act: “No promoter or an apartment owner shall transfer or hand over the possession of any apartment constructed after the commencement of this Act without executing an appropriate transfer deed and also getting it registered under the provisions of the Registration Act, 1908 and it shall also be incumbent for such promoter or apartment owner to enclose a true copy of the declaration made under Section 12 to such deed of transfer.”
Not registering the flats means that the homeowners do not have the right of ownership of the property.
According to the officials of the stamps department, as many as 10,000 homes constructed by various developers remain unregistered. These un-registered units are spread across localities such as Vasundhara, Indirapuram, Vaishali and Raj Nagar Extension.
